Version 1.3 · Effective October 30, 2026
Please read these terms before you agree
Educational and wellness only
Everything we provide is for educational and general wellness purposes. It is not intended to diagnose, treat, cure, or prevent any disease, and it is not a substitute for care from your own licensed clinician.
Not a clinical genetic test
We interpret raw data you obtained from a consumer testing company. We do not perform laboratory testing. Our reports are not clinical diagnostic results and should not be used to make medical decisions without confirmatory clinical testing.
Your genetic data, and what happens to it
You authorize us to process your raw genetic file to extract a defined panel of markers. The raw file is deleted after extraction. You may request deletion of your remaining data at any time.
Disputes are resolved by arbitration
You and we agree to resolve disputes through individual binding arbitration and to waive jury trials and class actions. You may opt out of arbitration within 30 days of first accepting this agreement.
Limits on our liability
Our total liability to you is capped at the amount you paid us in the twelve months before the claim, and we are not liable for indirect or consequential damages, to the fullest extent the law allows.
This Participant Agreement, Informed Consent and Terms of Service (this "Agreement") is a binding legal contract between you ("you," "your," or "Participant") and Geneflammation ("we," "us," "our," or the "Company"), governing your access to and use of our websites, applications, reports, educational materials, coaching content, and related services (collectively, the "Services").
By checking the acceptance box, creating an account, submitting an intake form, uploading a file, or purchasing any product, you acknowledge that you have read this Agreement in its entirety, that you understand it, that you have had the opportunity to ask questions and to consult an advisor of your choosing, and that you agree to be bound by it. If you do not agree, you must not use the Services.
If you are accepting this Agreement on behalf of another person or an entity, you represent that you have the legal authority to bind that person or entity, and references to "you" include that person or entity.
"Raw Genetic Data" means the unprocessed genotype file that you obtained from a third-party consumer genetic testing company such as 23andMe or AncestryDNA and that you elect to upload to the Services.
"Panel Results" means the limited, defined set of genetic markers that we extract from your Raw Genetic Data and retain in order to produce your report.
"Lab Data" means laboratory results, imaging reports, or other health-related documents that you elect to upload.
"Report" means any educational output we generate for you, including narrative interpretation, nutritional guidance, lifestyle guidance, shopping lists, and marker summaries.
"Personal Information" means information that identifies, relates to, or could reasonably be linked with you, including Raw Genetic Data, Panel Results, and Lab Data.
THE SERVICES ARE PROVIDED SOLELY FOR EDUCATIONAL, INFORMATIONAL, AND GENERAL WELLNESS PURPOSES. THEY ARE NOT INTENDED TO DIAGNOSE, TREAT, CURE, MITIGATE, OR PREVENT ANY DISEASE OR MEDICAL CONDITION.
The Services are designed to help you understand publicly available scientific literature as it may relate to general categories of biological function, including methylation, detoxification, oxidative stress, and inflammatory terrain. The Services are educational commentary on that literature. They are not a clinical evaluation of you.
Nothing in the Services constitutes the practice of medicine, nursing, dietetics, psychology, or any other licensed profession. No content provided through the Services should be interpreted as a clinical recommendation specific to your circumstances.
Use of the Services does not create a physician-patient, practitioner-patient, therapist-client, or any other professional treatment relationship between you and the Company, or between you and any physician, clinician, author, contributor, employee, contractor, or agent associated with the Company, including any individual whose name, credentials, likeness, or research appears in our materials.
The presence of a medical credential in our content signifies the educational provenance of that content. It does not signify that a clinical relationship has been formed with you, that your individual circumstances have been evaluated, or that any clinical judgment has been exercised on your behalf.
You must consult your own licensed healthcare provider before beginning, changing, or discontinuing any diet, supplement, exercise program, medication, or other health-related course of action. Never disregard professional medical advice, and never delay seeking it, because of something you read in a Report or elsewhere in the Services.
IF YOU BELIEVE YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL YOUR LOCAL EMERGENCY NUMBER OR GO TO THE NEAREST EMERGENCY DEPARTMENT IMMEDIATELY. DO NOT USE THE SERVICES TO SEEK EMERGENCY CARE.
We do not operate a clinical laboratory, and we do not perform genetic testing, sequencing, genotyping, or specimen analysis of any kind. We interpret data files that you obtained from a third party and voluntarily provide to us.
Our Reports are not clinical laboratory results. They have not been generated by a laboratory certified under the Clinical Laboratory Improvement Amendments ("CLIA"), and they are not validated for clinical diagnostic use. Consumer genotyping data is generated for recreational and informational purposes and is understood within the scientific community to carry error rates that make it unsuitable, without confirmatory testing, as a basis for medical decision-making.
Any genetic finding that could plausibly influence a medical decision must be independently confirmed through clinical-grade testing ordered and interpreted by a qualified licensed provider, ideally with the involvement of a certified genetic counselor.
Statements made through the Services regarding nutrition, dietary supplements, botanicals, or lifestyle practices have not been evaluated by the United States Food and Drug Administration or by any comparable regulatory authority in any other jurisdiction.
No product or practice discussed through the Services is intended to diagnose, treat, cure, or prevent any disease. Discussion of a substance or practice in the Services is educational and does not constitute a recommendation, endorsement, prescription, or direction to use it.
You must be at least eighteen (18) years of age and have the legal capacity to enter into a binding contract in your jurisdiction in order to use the Services.
A parent or legal guardian who is at least eighteen (18) years of age may upload Lab Data for their own child aged two (2) through seventeen (17). By doing so, the parent or legal guardian consents to our processing of the child's Lab Data as described in this Agreement, confirms that the allergy and dietary answers given are the child's, and accepts this Agreement on the child's behalf. Reports for children use pediatric reference ranges, give food and lifestyle education only, and do not suggest supplements. We do not accept Raw Genetic Data relating to any individual under the age of eighteen, and we do not accept any data relating to a child under the age of two. If we become aware that we have received such information, we will delete it.
You may not upload data relating to another living or deceased person unless you are that person's legally authorized representative and you have the lawful right and that person's informed consent to do so. You bear sole responsibility for confirming that you hold that authority.
You represent and warrant that: (a) the Raw Genetic Data and Lab Data you upload are your own, or that you are lawfully authorized to upload them; (b) you obtained them lawfully; (c) uploading them to us does not violate any agreement you have with the third-party testing company or laboratory that generated them; (d) you have the right to grant us the permissions described in this Agreement; and (e) the information you provide about yourself, including your health history and any allergy or intolerance disclosures, is accurate and complete.
You are solely responsible for the accuracy of what you submit. Reports are generated from what you tell us and what your files contain. Inaccurate or incomplete input will produce inaccurate or incomplete output.
You expressly, voluntarily, and knowingly authorize the Company to receive, store, access, process, analyze, and interpret your Raw Genetic Data for the purpose of generating your educational Report and providing the Services you have requested.
You understand that genetic information is a uniquely sensitive category of personal information, that it is immutable, that it may reveal information about your ancestry, your biological relationships, and your predisposition to certain traits or conditions, and that once disclosed it cannot be made secret again.
You confirm that you are providing this authorization freely and not as a condition of employment, insurance, education, or any other benefit, and that no person has coerced or pressured you into providing your genetic information to us.
Your consent is specific to the purposes described in this Agreement. We will not use your Raw Genetic Data or Panel Results for research, product development involving identifiable data, or any purpose materially different from those described here without obtaining your separate, additional, opt-in consent.
The Company is not affiliated with, endorsed by, sponsored by, or in any partnership with 23andMe, AncestryDNA, or any other consumer genetic testing company. All trademarks are the property of their respective owners and are referenced only to identify file formats we accept.
Your relationship with the company that generated your Raw Genetic Data is governed by your agreement with that company, not by this Agreement. We have no control over, and accept no responsibility for, the accuracy of the data they produced, their privacy practices, their retention of your sample, or any change they make to their terms.
We make no representation as to whether your upload to us is permitted under your agreement with that company. Confirming that is your responsibility.
When you upload Raw Genetic Data, we scan the file for a defined panel of genetic markers relevant to the educational report you purchased. We extract only those markers.
After extraction, the raw file is deleted from our systems. We retain the extracted Panel Results, your report content, and the associated account and transaction records for the period described in Section 13.
We do not retain your full genome, your full genotype file, or markers outside the defined panel after extraction is complete.
Consumer genotyping arrays read a limited, pre-selected subset of positions in the genome. They do not sequence your genome. As a direct consequence, there are meaningful limits on what any interpretation service, including ours, can report.
Some markers within our panel may not be present in your particular file, because coverage differs between testing companies and between chip versions used by the same company at different times. Where a marker is absent, your Report will indicate that it was not found rather than infer a result. A marker reported as not found is not a normal result; it is an absence of data.
Certain genetic variations cannot be determined from consumer genotyping data at all. This includes, without limitation, whole-gene deletion polymorphisms such as those affecting GSTM1 and GSTT1, most insertions and deletions, copy number variation, repeat expansions, and structural variants. We do not report on these, and their absence from your Report carries no implication about your status.
Genotyping platforms produce occasional erroneous calls. A single unconfirmed marker should never be treated as established fact about your biology.
The scientific literature relating genetic variants to biological function is incomplete, is frequently revised, and in many cases rests on studies of limited size or limited population diversity. Associations reported today may be weakened, qualified, or overturned by later research. Much of the published evidence derives disproportionately from populations of European ancestry and may be less applicable to individuals of other ancestries.
A genetic variant describes a probabilistic tendency within a population. It does not determine your health, and it does not predict your future.
We employ commercially reasonable administrative, technical, and physical safeguards designed to protect Personal Information, including encryption of data in transit, access controls limiting internal access to personnel with a legitimate need, and logging of administrative access to participant records.
No method of electronic transmission or storage is completely secure. We cannot and do not guarantee absolute security, and you acknowledge that you provide Personal Information at your own risk.
We retain Panel Results, Reports, and account records for as long as your account is active and thereafter for the period required to satisfy our legal, accounting, tax, and dispute-resolution obligations, after which they are deleted or de-identified. Transaction records may be retained longer where required by law.
In the event of a data breach affecting your Personal Information, we will notify you and the applicable authorities as and when required by applicable law.
You may at any time request access to the Personal Information we hold about you, request correction of inaccurate information, request deletion of your data, request a portable copy of your data, or withdraw your consent to further processing, by contacting reports@geneflammation.com.
Withdrawal of consent is prospective. It does not undo processing already lawfully performed, and it does not obligate us to recall Reports already delivered to you. Withdrawal may make it impossible for us to continue providing the Services, and withdrawal after a Report has been generated does not entitle you to a refund.
We will honor deletion requests except where retention is required by law, necessary to establish or defend legal claims, or necessary to complete a transaction you initiated.
You acknowledge that you have considered the following risks before choosing to share genetic information with us.
Genetic information about you is also, in part, information about your biological relatives. Learning something about yourself may reveal information about your parents, children, siblings, and extended family, who have not consented to that disclosure. This includes the possibility of revealing unexpected biological relationships or their absence.
In the United States, the Genetic Information Nondiscrimination Act of 2008 ("GINA") prohibits most health insurers and most employers with fifteen or more employees from discriminating on the basis of genetic information. GINA's protections are not comprehensive. GINA does not apply to life insurance, disability insurance, or long-term care insurance, and it does not apply to certain employers, including the United States military. Protections outside the United States vary widely.
Learning about genetic variants may cause anxiety, distress, or changes in how you view your health or your family. Some individuals find genetic information difficult to receive. If you anticipate that this may be true for you, we encourage you to involve a licensed clinician or a certified genetic counselor before proceeding.
Once genetic information exists in digital form, the possibility of future unauthorized access, compelled disclosure, or re-identification cannot be reduced to zero.
Where the Services permit you to upload Lab Data, the same principles apply. We do not perform the laboratory testing, we do not verify the provenance or accuracy of the documents you upload, and our commentary on them is educational rather than clinical.
We do not review uploaded Lab Data for urgent or critical findings, and you must not rely on us to identify, flag, or escalate any abnormal or dangerous value. Reviewing your laboratory results for clinically significant findings is the responsibility of the licensed provider who ordered them.
Turnaround times for educational commentary are estimates and are not guaranteed. Delays are not a basis for a claim of harm.
Where the Services ask you to disclose food allergies, sensitivities, or intolerances, you are responsible for providing complete and accurate information. Our automated filtering of food and supplement suggestions relies entirely on what you disclose.
Automated filtering is a convenience feature and is not a safety system. It may fail to identify a derivative ingredient, a cross-contamination risk, a regional product formulation, or an allergen described by an unfamiliar name.
YOU MUST INDEPENDENTLY VERIFY EVERY FOOD, INGREDIENT, AND SUPPLEMENT AGAINST YOUR OWN KNOWN ALLERGIES AND INTOLERANCES BEFORE CONSUMING IT. If you have a history of anaphylaxis or any severe allergic reaction, consult your allergist before making dietary changes based on any material we provide.
Educational discussion of dietary supplements is not a prescription, a recommendation to purchase, or an assurance of safety or efficacy. Dietary supplements are regulated as foods rather than as drugs in the United States and are not subject to pre-market approval for safety or effectiveness.
Supplements can interact with prescription medications, can be contraindicated in pregnancy, lactation, and in certain medical conditions, and can be harmful at doses that are safe for others. Any dose range mentioned in our materials is a summary of published literature and is not a dose recommended for you.
Do not begin any supplement without first consulting your prescribing clinician or pharmacist, particularly if you are pregnant, nursing, under eighteen, managing a chronic condition, scheduled for surgery, or taking any prescription medication.
You acknowledge and consent that the Services use automated systems, including artificial intelligence and large language models, to help generate narrative interpretation, nutritional guidance, and other Report content, and that your uploaded content may be processed by those systems and by our service providers for that purpose.
Automated systems can produce output that is incomplete, outdated, internally inconsistent, or incorrect. Report content is not individually authored, verified, or clinically reviewed for each participant unless we expressly state otherwise for a specific product.
You agree not to rely on automated output as a substitute for professional judgment.
Any coaching, program, module, or educational cohort offered through the Services is a wellness education service. Coaches and facilitators are not acting as your licensed healthcare providers, and their guidance is not clinical care, psychotherapy, or nutrition therapy for a diagnosed condition.
Program participation requires your active engagement. We provide education and structure; we do not and cannot perform the behavior change on your behalf.
We make no representation, warranty, or guarantee that you will experience any particular outcome, improvement, symptom change, biomarker change, or health benefit from using the Services.
Testimonials, case descriptions, and examples appearing in our materials reflect individual experiences. They are not typical, they are not predictive of your results, and they are not a warranty of any outcome.
Prices are displayed at the point of purchase and are payable in advance. Payments are processed by our third-party payment processor; we do not receive or store your full payment card details. You authorize the charge shown at checkout, including applicable taxes.
Memberships are sold on a no-refund basis. Payments already made are not returned, in whole or in part, except where a refund is required by applicable law.
Cancelling stops the next renewal. Access continues for the remainder of the period already paid for, and at the end of that period the membership ends and the account returns to the free allowance.
Chargebacks initiated without first contacting us to resolve the issue may result in suspension of your account.
Subscription products renew automatically at the then-current price for successive terms until cancelled. You may cancel at any time; cancellation takes effect at the end of the then-current paid term, and you retain access for the remainder of that term.
We do not provide partial-term refunds on cancellation except where required by law. We will provide notice of any price change in advance of the renewal to which it applies.
Following cancellation or expiration, Reports already generated for your account remain accessible to that account without expiration, on every tier. Cancellation or expiration ends your ability to generate new Reports; it does not remove access to Reports you already have. You may still download and retain your own copies at any time, and you may request deletion of your data under Section 14.
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. Notify us promptly of any unauthorized use.
You agree not to: use the Services for any unlawful purpose; upload malicious code; attempt to gain unauthorized access to our systems or another participant's data; scrape, harvest, or reverse engineer any part of the Services; resell, sublicense, or commercially redistribute Reports or educational materials; misrepresent your identity; or use the Services to provide clinical services to third parties.
We may suspend or terminate your access for violation of this Section without refund.
All content comprising the Services, including text, protocols, frameworks, report templates, graphics, software, and the compilation thereof, is owned by the Company or its licensors and is protected by intellectual property law.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use your Report and the educational materials for your own personal, non-commercial use. All rights not expressly granted are reserved.
You retain ownership of your Raw Genetic Data and Lab Data. You grant us a limited license to use them solely as necessary to provide the Services to you.
You consent to receive communications from us electronically, including transactional messages relating to your account, purchases, and Reports. These are a necessary part of the Services and cannot be opted out of while your account is active.
You may receive educational newsletters and marketing communications, and you may unsubscribe from those at any time using the link included in each message or by contacting us. Unsubscribing from marketing does not affect transactional messages.
Our Privacy Policy is incorporated into this Agreement by reference and describes how we collect, use, disclose, and safeguard Personal Information. Where the Privacy Policy and this Agreement conflict as to privacy practices, the Privacy Policy governs.
We use third-party service providers, including hosting, payment processing, email delivery, and automated analysis providers, who process Personal Information on our behalf under contractual confidentiality and security obligations.
WE DO NOT SELL YOUR GENETIC INFORMATION. We do not share identifiable genetic information with insurers, employers, data brokers, or advertisers.
We may disclose Personal Information where compelled by valid legal process, where necessary to protect the rights, property, or safety of any person, or in connection with a merger, acquisition, financing, or sale of assets, in which case we will seek to ensure the receiving party is bound by protections no less protective than those in this Agreement and will notify you as required by law.
Because we are not a covered entity or a business associate under the Health Insurance Portability and Accountability Act ("HIPAA"), the information you provide to us is generally not protected health information under HIPAA and does not carry HIPAA's protections. We nonetheless apply the safeguards described in this Agreement and in our Privacy Policy.
Certain jurisdictions impose specific requirements on the collection and use of genetic information, including state genetic privacy statutes in the United States, some of which provide individual enforcement rights. Where such a law applies to you and grants you rights greater than those described here, that law governs to the extent of the difference.
[Counsel to confirm applicability of, at minimum, the Illinois Genetic Information Privacy Act, applicable state consumer genetic privacy acts, and state comprehensive privacy statutes to the Company's participant base.]
The Services are operated from the United States. If you access them from elsewhere, you do so on your own initiative and are responsible for compliance with local law, and you consent to the transfer, storage, and processing of your Personal Information in the United States, where data protection law may differ from that of your jurisdiction.
If you are located in the European Economic Area or the United Kingdom, our lawful basis for processing genetic data is your explicit consent under Article 9(2)(a) of the General Data Protection Regulation, and for other processing is the performance of our contract with you and our legitimate interests. You have the rights of access, rectification, erasure, restriction, portability, and objection, the right to withdraw consent at any time, and the right to lodge a complaint with your supervisory authority.
[Counsel to confirm whether an EU/UK representative and standard contractual clauses are required given the Company's actual participant geography.]
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY.
WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, OR CURRENT.
Some jurisdictions do not allow the exclusion of implied warranties, so portions of this Section may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER THE COMPANY NOR ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, ADVISORS, OR LICENSORS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR ANTICIPATED SAVINGS, ARISING OUT OF OR RELATING TO THE SERVICES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100).
WITHOUT LIMITING THE FOREGOING, WE SHALL HAVE NO LIABILITY FOR ANY DECISION YOU MAKE, OR DECLINE TO MAKE, REGARDING YOUR HEALTH, MEDICAL CARE, DIET, SUPPLEMENTATION, OR MEDICATION IN RELIANCE ON THE SERVICES.
These limitations apply even if a limited remedy fails of its essential purpose. Some jurisdictions do not permit certain limitations of liability, and nothing in this Agreement excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.
You knowingly and voluntarily assume all risks associated with your use of the Services, including the risks described in Sections 12 and 15, and including any risk arising from dietary, supplement, or lifestyle changes you elect to make.
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, contractors, advisors, and licensors from and against any claim, demand, loss, liability, damage, cost, or expense, including reasonable attorneys' fees, arising out of or relating to your use of the Services, your breach of this Agreement, your violation of any law, your infringement of any third-party right, or your upload of data you were not authorized to provide.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
Before initiating any formal proceeding, you agree to first contact us at reports@geneflammation.com with a written description of the dispute and to attempt in good faith to resolve it informally for a period of sixty (60) days.
If the dispute is not resolved, you and we agree that any dispute, claim, or controversy arising out of or relating to the Services or this Agreement shall be resolved exclusively by final and binding individual arbitration administered by [ARBITRATION PROVIDER] under its then-current consumer arbitration rules, before a single arbitrator, in [VENUE], or by telephone or videoconference at your election, or in your county of residence where required by applicable rules.
YOU AND WE EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any form of representative proceeding.
Either party may bring an individual claim in small claims court instead of arbitration, and either party may seek injunctive relief in court to protect intellectual property rights.
RIGHT TO OPT OUT: You may reject this arbitration provision by sending written notice to reports@geneflammation.com with the subject line "Arbitration Opt-Out," including your name and the email associated with your account, within thirty (30) days of first accepting this Agreement. Opting out affects no other part of this Agreement and will not affect your access to the Services.
If the class action waiver is found unenforceable as to a particular claim, that claim shall proceed in court, and the remainder of this Section shall continue to apply to all other claims.
This Agreement is governed by the laws of the State of [STATE], United States, without regard to its conflict-of-laws principles, and, where applicable, by the Federal Arbitration Act.
To the extent any dispute is not subject to arbitration, the state and federal courts located in [COUNTY, STATE] shall have exclusive jurisdiction, and you consent to personal jurisdiction there.
Any claim arising out of or relating to the Services must be brought within one (1) year after it arises, or it is permanently barred, except where a longer period is required by law.
We may modify this Agreement from time to time. The version in effect is identified by the version number and effective date at the top of this document, and each version you accept is recorded against your account.
Material changes will be communicated to you by email or by prominent notice within the Services before they take effect. Your continued use of the Services after the effective date constitutes acceptance of the revised Agreement. Where a change materially expands our use of your genetic information, we will obtain your fresh opt-in consent rather than relying on continued use.
If you do not accept a revised Agreement, your remedy is to stop using the Services and request deletion of your data.
You may terminate this Agreement at any time by ceasing use of the Services and requesting account closure. We may suspend or terminate your access at any time for breach of this Agreement, suspected fraud, or where required by law.
Sections concerning intellectual property, disclaimers, limitation of liability, indemnification, arbitration, governing law, and any other provision that by its nature should survive, shall survive termination.
You consent to transact electronically and agree that your act of checking the acceptance box constitutes your electronic signature, legally equivalent to a handwritten signature under the Electronic Signatures in Global and National Commerce Act and comparable law.
You agree that we may maintain an electronic record of your acceptance, including the version of the Agreement accepted, the date and time of acceptance, the email address associated with the acceptance, and the affirmations you checked, and that such record shall be admissible evidence of your agreement.
You may request a copy of your acceptance record at any time by contacting reports@geneflammation.com.
If any provision of this Agreement is held unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remainder shall continue in full force.
Our failure to enforce any provision is not a waiver of it. You may not assign this Agreement without our written consent; we may assign it in connection with a merger, acquisition, or sale of assets.
This Agreement, together with the Privacy Policy and any product-specific terms presented at the point of sale, constitutes the entire agreement between you and us and supersedes all prior understandings on its subject matter.
Nothing in this Agreement creates any partnership, joint venture, employment, or agency relationship, and there are no third-party beneficiaries.
We are not liable for any failure or delay in performance caused by events beyond our reasonable control.
Questions about this Agreement, requests regarding your data, and arbitration opt-out notices should be directed to reports@geneflammation.com.
[Counsel to insert registered legal entity name, registered business address, and, where required, the identity of the data protection contact.]
