Critical Disclaimers — Please Read First

  • No Physician-Patient Relationship: Use of this Platform and Services does not create any physician-patient relationship with Dr. Alberto Rivera or any affiliated parties.
  • Not a Substitute for Professional Care: The educational information provided does not replace the advice, evaluations, or care from your primary care physician or other qualified healthcare providers. Consult your doctor before making any health-related decisions.
  • Educational Only: All content is for educational purposes only and is not medical advice, diagnosis, or treatment.
  • No Laboratory Testing: We perform no laboratory testing, collect no specimens, and operate no laboratory. We interpret data you already have. We recommend no laboratory test and no clinician.

1. Introduction and Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of the DecodingInflammation.com website, associated platforms, tools, educational content, the Inflammation DNA Blueprint, and all related services (collectively, the "Platform" or "Services") operated by or on behalf of Dr. Alberto Rivera, MD, FAAPMR, and related entities ("we," "us," "our," or the "Company").

By accessing, browsing, or using the Platform in any way, creating an account, purchasing any Service, uploading any data (including raw genetic data), downloading reports, or otherwise interacting with the Services, you ("you," "User," or "Client") acknowledge that you have carefully read, fully understood, and expressly agree to be legally bound by these Terms, our Privacy Policy, all disclaimers, and any additional rules or policies referenced herein. If you do not agree to any part of these Terms, you must immediately cease all use of the Platform and Services.

These Terms constitute a binding legal contract between you and the Company. We reserve the right to modify these Terms at any time. We will make reasonable efforts to notify you of material changes (e.g., via email or prominent notice on the Platform). Your continued use after such changes constitutes acceptance of the revised Terms. It is your responsibility to review the Terms periodically.

2. Description of the Services

The Platform provides educational and informational resources in the fields of genomics, epigenetics, nutrigenomics, oxidative stress biology, methylation pathways, chronic inflammation, and precision wellness concepts, including those detailed in the GENEFLAMMATION framework developed by Dr. Alberto Rivera.

The flagship Inflammation DNA Blueprint ($249 per year) allows users to upload raw genetic data from third-party consumer testing services (such as 23andMe or AncestryDNA). Our system analyzes selected single nucleotide polymorphisms (SNPs) relevant to methylation and related biological systems and generates an educational report containing general insights, nutrition and dietary pattern suggestions, ideas for natural supplements, a personalized shopping list built from the markers found in the uploaded file, eating pattern and daily habit guidance, and lifestyle considerations.

ALL SERVICES ARE PROVIDED STRICTLY FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY. The Platform does not offer medical advice, clinical diagnosis, treatment plans, genetic counseling, or any regulated healthcare services. Nothing on this Platform is intended as, nor should be construed as, medical advice, diagnosis, treatment, or any form of healthcare service.

3. No Physician-Patient Relationship and No Replacement for Professional Medical Care

CRITICAL NOTICE: Your use of the Platform, purchase of any Service, upload of genetic data, receipt of any report, or any other interaction does not create, establish, or constitute a physician-patient relationship of any kind between you and Dr. Alberto Rivera, MD, FAAPMR, or any individual or entity associated with the Platform. No doctor-patient relationship is formed through account creation, data upload, purchase, report generation, use of AI tools, or any other interaction with the Platform.

Furthermore, the educational information, reports, suggestions, and content provided through the Services do not replace, substitute for, or take the place of the professional advice, evaluations, diagnoses, treatments, monitoring, or ongoing care provided by your primary care physician, specialists, or other qualified licensed healthcare providers.

You are strongly advised and expected to consult with your primary care physician or appropriate licensed healthcare professional BEFORE acting on any information received from the Platform, including but not limited to: implementing dietary changes, starting or stopping any supplement, undergoing laboratory testing, making modifications to existing medications or treatments, or making any other modifications to your health or wellness regimen.

Always seek and follow the advice of your own healthcare team for any health concerns, symptoms, medical conditions, or before making any healthcare decisions. Never disregard professional medical advice or delay seeking it because of content found on or through this Platform.

NO REGULATED COMPOUNDS AND NO LABORATORY TESTING: The Platform does not discuss, recommend, prescribe, endorse, sell, or provide access to peptides, research compounds, medications, or any other regulated substance. The Platform performs no laboratory testing, collects no specimens, operates no laboratory, and sells no physical product of any kind. Every report is generated from data the user already possesses and uploads herself. The Platform recommends no laboratory test, names no clinician or specialty, and issues no referral.

4. Genetic Data Upload, Processing, and Limitations

NATURE OF RAW DNA DATA: The Platform accepts raw genetic data files from consumer genetic testing services (23andMe, AncestryDNA). These raw data files are not the equivalent of clinical genetic tests conducted in CLIA-certified laboratories. Consumer raw DNA data is subject to significantly higher error rates and may contain genotyping artifacts, strand orientation errors, or platform-specific variations that affect accuracy.

LIMITED SNP PANEL: The Inflammation DNA Blueprint analyzes only a selected subset of genetic markers (SNPs) relevant to the methylation and GENEFLAMMATION framework. It does not provide comprehensive genomic analysis, exome sequencing, whole-genome sequencing, or clinically validated genetic panel testing. The absence of a risk variant in our panel does not mean the variant is absent in your genome; our analysis is limited to the specific markers in our panel.

NOT DIAGNOSTIC: The genetic variant information and educational interpretations provided are not a clinical genetic diagnosis. Individual SNPs do not determine health outcomes in isolation. Genetic variants interact with environmental factors, epigenetic modifications, other genes, nutrition, lifestyle, and countless other variables in ways that current science cannot fully characterize.

DATA SECURITY AND DELETION: Your raw DNA file is uploaded through an encrypted connection and processed solely to extract the SNP markers included in the inflammation panel. The raw DNA file is permanently and irrevocably deleted from our systems upon completion of analysis. Only the processed variant call results (individual genotypes for specific rsIDs) are retained to generate and display your educational report. We do not sell, share, or license your genetic data to third parties for any purpose, including research, advertising, or marketing.

DATA RETENTION AND DELETION RIGHTS: You may request deletion of all retained variant data and report records at any time through the deletion function within your report portal or by contacting us at reports@geneflammation.com. Upon confirmed deletion, we will remove all identifiable genotype data from our active systems within a commercially reasonable timeframe.

BY UPLOADING YOUR RAW DNA FILE, you grant the Company a limited, non-exclusive, non-transferable license to process, analyze, and use your genetic data solely for the purpose of generating your educational report and providing the Services. You represent that the genetic data you upload is your own or that you have full legal authority to upload and have analyzed.

5. User Accounts, Representations, and Responsibilities

ELIGIBILITY: You represent and warrant that you are at least 18 years of age and have the full legal capacity and authority to enter into this Agreement. The Services are not directed to minors. By using the Services, you represent that you meet this age requirement.

ACCURACY OF INFORMATION: You agree to provide accurate, current, and complete information when creating an account, completing a purchase, or uploading data. You are responsible for maintaining the accuracy of your account information and for all activity that occurs under your account.

ACCOUNT SECURITY: You are responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify us of any unauthorized use of your account.

PROHIBITED CONDUCT: You agree not to: (a) use the Platform for any unlawful purpose; (b) upload genetic data belonging to another person without their explicit written consent; (c) attempt to circumvent the Platform's security measures; (d) use automated systems or bots to access the Platform without authorization; (e) reproduce, distribute, or commercially exploit any content from the Platform without prior written permission; (f) misrepresent the Services to others as providing medical advice, diagnoses, or treatment; or (g) upload files that are not genuine raw DNA data files from authorized consumer testing platforms.

ACKNOWLEDGMENT OF EDUCATIONAL LIMITATIONS: You expressly acknowledge that you understand the educational-only nature of the Services and their significant limitations as described in these Terms, and that you will consult your primary care physician or healthcare provider before making any health-related decisions based on information received through the Platform.

6. Payments, Fees, and Refund Policy

PRICING: The Inflammation DNA Blueprint is currently priced at $249 USD per year and renews annually at $249 until you cancel. Essential is $149 USD per year and Essential Duo is $199 USD per year for two seats. Every membership can be cancelled at any time from account settings. Prices are subject to change at our discretion with reasonable notice. All prices are in United States Dollars.

PAYMENT PROCESSING: Payments are processed securely through Stripe, Inc., a third-party payment processor. By completing a purchase, you agree to Stripe's Terms of Service and Privacy Policy in addition to these Terms. We do not store full credit card information on our servers.

REFUND POLICY: All memberships are sold on a no-refund basis, except where a refund is required by applicable law. Payments already made are not returned, in whole or in part, when you cancel. Cancelling stops the next renewal and nothing further is charged. Your access continues for the remainder of the period you have already paid for, and at the end of that period the membership ends and your account returns to the free allowance.

If you experience a technical failure that prevents your service being delivered entirely, you may contact us at reports@geneflammation.com within 48 hours to request a review of your situation. We reserve the sole discretion to determine whether a credit is appropriate in such circumstances. Dissatisfaction with report content, interpretations, or educational recommendations does not constitute grounds for a refund.

TAXES: You are responsible for any applicable taxes, duties, or levies imposed by your jurisdiction on your purchase.

6A. Memberships: Billing, Cancellation, and Access After the Paid Period

BILLING INTERVALS: Essential may be billed annually at $149, or as three payments of $49.99 charged every four months, totalling $149.97 per year. Essential Duo and the Inflammation DNA Blueprint are billed annually only. Whichever option is selected, the amount shown at checkout is the amount charged at checkout, and the schedule continues at that amount and that interval until you cancel.

CANCEL ANY TIME: You may cancel a membership at any time, directly from your account settings, without contacting support and without providing a reason. There is no minimum term and no mid-term restriction on cancellation.

ACCESS CONTINUES THROUGH THE PAID PERIOD: Cancellation stops future payments. Your membership remains fully active through the end of the period you have already paid for, whether that period is a month or a year. The exact date your access ends is displayed on screen when you cancel and remains visible in your account settings.

REPORTS ALREADY GENERATED REMAIN ACCESSIBLE PERMANENTLY: Every report generated on your account remains readable by that account permanently, on every tier, including after cancellation and after the paid period ends. There is no post-cancellation expiry period. Cancellation ends your ability to generate new reports under the membership; it never removes access to reports you already have. You may download and keep your own copies at any time, and you may request deletion of your data as described in these Terms.

AFTER THE PAID PERIOD ENDS: When the paid period ends, your account returns to the free allowance of one report per rolling twelve month period. Reports that were generated while your paid membership was active remain readable and do not count against that free allowance.

CANCELLATION: You may cancel at any time from your account settings. Cancellation takes effect at the end of the period you have already paid for. Partial-period refunds are not provided on cancellation, and no refund is issued for a period already paid, except where required by applicable law.

PRICE CHANGES: Memberships renew automatically at the then-current price until cancelled. We will provide notice of any price change in advance of the renewal to which it applies.

7. Intellectual Property Rights

OWNERSHIP: All content on the Platform, including but not limited to the GENEFLAMMATION framework, OFRC framework, report templates, educational text, SNP interpretations, graphic designs, logos, trade names, and software, is owned by or licensed to the Company and is protected by applicable intellectual property laws, including copyright and trademark law.

LIMITED LICENSE: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and your personal educational report solely for your own personal, non-commercial purposes. This license does not include the right to: reproduce, distribute, sell, or commercially exploit Platform content; modify or create derivative works; use any Company trademarks or service marks without express written permission; or scrape, data-mine, or automatically extract content from the Platform.

YOUR CONTENT: By uploading your raw DNA data, you grant us the limited processing license described in Section 4. You retain ownership of your genetic data.

FEEDBACK: Any feedback, suggestions, or ideas you provide regarding the Platform may be used by us without compensation or attribution to you.

8. Disclaimers of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION:

(a) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT; (b) ANY WARRANTY THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (c) ANY WARRANTY REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, OR USEFULNESS OF THE EDUCATIONAL CONTENT, GENETIC INTERPRETATIONS, OR REPORT RECOMMENDATIONS; (d) ANY WARRANTY THAT THE RESULTS OBTAINED FROM USE OF THE SERVICES WILL BE ACCURATE, BENEFICIAL, OR MEET YOUR EXPECTATIONS; (e) ANY WARRANTY REGARDING THE SUITABILITY OF ANY DIETARY SUGGESTIONS, SUPPLEMENT IDEAS, OR LIFESTYLE PROTOCOLS FOR YOUR INDIVIDUAL CIRCUMSTANCES.

The Company does not warrant that raw genetic data will be accurately processed in all cases, as processing accuracy depends on the quality and format of your uploaded file.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

(a) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; (b) DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES; (c) DAMAGES ARISING FROM YOUR RELIANCE ON ANY EDUCATIONAL CONTENT, REPORT INTERPRETATIONS, SUPPLEMENT IDEAS, OR OTHER INFORMATION PROVIDED THROUGH THE SERVICES; (d) DAMAGES ARISING FROM HEALTH DECISIONS MADE BASED ON THE SERVICES WITHOUT CONSULTING A LICENSED HEALTHCARE PROVIDER; (e) DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA;

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, THE COMPANY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO THE COMPANY FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the above limitations shall apply to the fullest extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, contractors, agents, licensors, suppliers, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

(a) your violation of these Terms; (b) your use of the Platform or Services in a manner inconsistent with these Terms; (c) your provision of inaccurate or false information; (d) your uploading of genetic data belonging to another person without their consent; (e) your reliance on Platform content for medical decisions without consulting a licensed healthcare provider; (f) your violation of any third-party rights; or (g) any claim by a third party arising from your use of the Services.

11. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy, incorporated herein by reference, describes how we collect, use, store, process, and disclose personal information and genetic data obtained through the Platform. By using the Services, you consent to the data practices described in the Privacy Policy.

GENETIC DATA: As described in Section 4, we process your raw DNA file solely to generate your educational report. Raw files are permanently deleted after analysis. We do not sell, license, or share your genetic data with third parties for research, commercial, or any other purpose without your explicit written consent.

HIPAA NOTICE: While we strive to implement industry-standard data security practices, this Platform is not a HIPAA-covered entity and the Services are not HIPAA-regulated healthcare services. However, we implement security measures consistent with best practices for handling sensitive personal information.

DATA BREACH: In the event of a data breach that materially affects your personal information, we will notify you as required by applicable law.

12. Termination and Suspension

We reserve the right to suspend, restrict, or terminate your access to the Platform and Services at any time, with or without notice, for any reason, including but not limited to: violation of these Terms, fraudulent or abusive behavior, provision of false information, or activities that may harm the Company or other users.

You may discontinue use of the Platform at any time. If you wish to delete your account and all associated data, contact us at reports@geneflammation.com.

Upon termination for any reason, Sections 3, 7, 8, 9, 10, 12, and 13 shall survive and remain in full force and effect.

13. Governing Law, Dispute Resolution, and Miscellaneous

GOVERNING LAW: These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
